    WORKKE ACCEPTABLE USE POLICY

    1. Purpose

    This Acceptable Use Policy ("Policy") establishes the rules for acceptable use of the WorkKE Platform.

    WorkKE ("WorkKE", "we", "our", or "us") provides a digital marketplace through which Clients, freelancers, cybercafés, businesses, Vendors, Digital Store sellers, trainers, buyers, and other Users can connect, communicate, buy and sell products and services, and conduct marketplace transactions.

    This Policy applies to all WorkKE features and services, including:

    • User accounts and profiles;
    • jobs and projects;
    • proposals and applications;
    • messaging;
    • freelance services;
    • cybercafé services;
    • Digital Stores;
    • digital products;
    • WorkKE Academy and training;
    • Wallet functionality;
    • payments and payouts;
    • WorkKE Coins and credits;
    • reviews and ratings;
    • files and uploads;
    • AI-powered features;
    • comments and other User Content; and
    • other current or future WorkKE services.

    By using WorkKE, you agree to comply with this Policy together with the WorkKE Terms of Service and other applicable policies.

    2. General Standard

    Users must use WorkKE lawfully, honestly, professionally, and in a manner that does not harm other Users, WorkKE, third parties, or the integrity of the marketplace.

    Users must not use WorkKE to:

    • violate applicable law;
    • commit or facilitate fraud;
    • deceive other Users;
    • infringe another person's rights;
    • distribute harmful Content;
    • compromise Platform security;
    • circumvent WorkKE systems;
    • abuse payment functionality; or
    • otherwise misuse the Platform.

    3. Account Integrity

    Users must provide accurate information when creating and maintaining their accounts.

    Users must not:

    • create accounts using false identities;
    • impersonate another person or organization;
    • use stolen identity information;
    • submit forged verification documents;
    • knowingly provide false KYC information;
    • buy or sell WorkKE accounts;
    • transfer accounts without authorization;
    • create multiple accounts to evade restrictions;
    • create accounts to manipulate transactions, promotions, ratings, or reviews; or
    • allow unauthorized persons to use their account.

    Users are responsible for maintaining the security of their login credentials.

    4. Fraud, Scams and Deceptive Activity

    WorkKE prohibits fraudulent or deceptive activity.

    Users must not:

    • operate scams;
    • create fake jobs or projects;
    • create fake proposals;
    • create fake Digital Store orders;
    • misrepresent products or services;
    • provide false payment confirmations;
    • submit forged receipts or screenshots;
    • falsely claim delivery or non-delivery;
    • manipulate transaction evidence;
    • misuse refunds or chargebacks;
    • create artificial marketplace transactions;
    • deceive Users regarding qualifications or experience; or
    • intentionally misrepresent material information.

    WorkKE may investigate suspicious activity and take appropriate action.

    5. Prohibited Jobs and Services

    Users must not post, request, offer, purchase, or provide jobs or services that are illegal or prohibited by WorkKE.

    Prohibited activities may include:

    • fraud;
    • identity theft;
    • document forgery;
    • hacking or unauthorized system access;
    • malware development or distribution;
    • phishing;
    • credential theft;
    • bypassing security systems without authorization;
    • creation or distribution of counterfeit documents;
    • unlawful surveillance;
    • theft or sale of personal information;
    • prohibited gambling services;
    • unlawful financial schemes;
    • pyramid or Ponzi schemes;
    • trafficking or exploitation;
    • prohibited weapons-related services;
    • unlawful drug-related services; and
    • other illegal activity.

    Legitimate cybersecurity, testing, research, or technical work may be permitted where the User has appropriate authorization and the activity complies with applicable law and WorkKE policies.

    6. Academic Integrity

    WorkKE may allow legitimate educational and academic support services such as:

    • tutoring;
    • proofreading;
    • editing;
    • research assistance;
    • data analysis;
    • statistical support;
    • formatting;
    • referencing support;
    • learning materials; and
    • educational guidance.

    Users must not use WorkKE to facilitate academic fraud.

    Prohibited activities include completing examinations or assessments on behalf of another person, impersonating students, obtaining examination materials unlawfully, or other services whose primary purpose is academic dishonesty.

    7. Digital Stores and Digital Products

    Digital Store Vendors may only sell products they have the legal right to sell or distribute.

    Users must not list, sell, purchase, or distribute:

    • pirated eBooks;
    • unauthorized copies of courses;
    • stolen templates;
    • cracked software;
    • counterfeit digital products;
    • illegally obtained databases;
    • leaked documents;
    • copyrighted images without appropriate rights;
    • stolen source code;
    • unauthorized software licences;
    • malware;
    • spyware;
    • credential-stealing tools; or
    • other illegal or infringing digital Content.

    Vendors may be required to provide evidence demonstrating ownership, licensing, or authorization to distribute a product.

    8. Intellectual Property

    Users must respect copyright, trademark, patent, trade-secret, and other intellectual property rights.

    Users must not upload, sell, publish, reproduce, distribute, or otherwise use Content unless they:

    • own the applicable rights;
    • have permission from the rights holder;
    • have an appropriate licence; or
    • are otherwise legally permitted to use the Content.

    WorkKE may remove Content following a valid intellectual property complaint.

    Repeat or serious infringement may result in account restrictions or termination.

    9. AI-Generated and AI-Assisted Content

    WorkKE may permit AI-generated and AI-assisted Content, products, services, or deliverables where otherwise permitted.

    Users remain responsible for Content created using artificial intelligence.

    Users must not use AI to:

    • facilitate fraud;
    • impersonate another person deceptively;
    • create forged documents;
    • circumvent Platform safeguards;
    • violate intellectual property rights;
    • generate prohibited Content;
    • deceive Clients about material aspects of a service where disclosure is required; or
    • engage in other activity prohibited by this Policy.

    Where WorkKE requires disclosure that Content or a product is AI-generated or AI-assisted, Users must provide accurate disclosure.

    10. Harmful Files and Software

    Users must not upload, distribute, sell, or transmit:

    • malware;
    • ransomware;
    • viruses;
    • spyware;
    • credential stealers;
    • malicious scripts;
    • malicious browser extensions;
    • unauthorized remote-access software;
    • files designed to damage systems; or
    • other harmful software.

    WorkKE may automatically scan uploaded files for security purposes.

    Suspicious files may be quarantined, restricted, or removed.

    11. Messaging and Communication

    Users must communicate professionally and must not use WorkKE messaging or other communication features to:

    • harass;
    • threaten;
    • bully;
    • intimidate;
    • stalk;
    • spam;
    • repeatedly send unwanted messages;
    • distribute scams;
    • distribute malware;
    • engage in unlawful discrimination;
    • solicit prohibited transactions; or
    • circumvent WorkKE marketplace protections.

    Users should report abusive or suspicious communication through available WorkKE reporting channels.

    12. Contact Information and Off-Platform Circumvention

    Users must not intentionally use WorkKE to identify another User and then move an applicable transaction outside the Platform to avoid WorkKE fees, payment protections, or marketplace controls.

    Before applicable transaction requirements are satisfied, WorkKE may restrict sharing of information such as:

    • phone numbers;
    • disguised phone numbers;
    • email addresses;
    • disguised email addresses;
    • WhatsApp details;
    • Telegram details;
    • direct payment details; or
    • links primarily intended to move transactions outside WorkKE.

    Users must not attempt to bypass these safeguards using:

    • spacing;
    • symbols;
    • words instead of numbers;
    • images;
    • coded language;
    • altered spelling;
    • external documents; or
    • other concealment techniques.

    13. Permitted External Links

    WorkKE may permit external links that have a legitimate marketplace purpose.

    Examples may include links to:

    • GitHub;
    • LinkedIn;
    • Behance;
    • Figma;
    • Google Drive;
    • professional portfolios;
    • collaboration tools; or
    • other approved resources.

    Permitted links must not be used primarily to:

    • solicit off-platform payment;
    • circumvent applicable fees;
    • distribute malware;
    • collect information deceptively; or
    • move a WorkKE transaction outside the Platform contrary to WorkKE rules.

    14. Contact Guard and Automated Moderation

    WorkKE may use automated and manual systems to detect Content that potentially violates this Policy.

    This may include detection of:

    • phone numbers;
    • email addresses;
    • disguised Contact Information;
    • WhatsApp or Telegram references;
    • direct payment requests;
    • prohibited links;
    • suspected fraud;
    • spam;
    • abusive Content;
    • prohibited products;
    • malicious files; and
    • attempts to circumvent Platform safeguards.

    Depending on the circumstances, WorkKE may:

    • display a warning before Content is submitted;
    • flag Content;
    • mask prohibited information;
    • replace information with "[contact hidden]";
    • maintain a moderation record;
    • record policy violations;
    • restrict messaging;
    • remove Content; or
    • refer activity for human review.

    15. Contact Unlock After Marketplace Commitment

    Where supported by WorkKE, certain Contact Information restrictions may be relaxed after an eligible marketplace relationship has been established.

    This may occur where, for example:

    • a job has been awarded and applicable funding requirements have been satisfied; or
    • the Users have previously completed an eligible WorkKE transaction together.

    Unlocking Contact Information does not permit Users to circumvent applicable payment obligations, fees, policies, or ongoing transaction requirements.

    16. False Positives and Moderation Review

    Automated detection systems may occasionally flag legitimate Content incorrectly.

    Where appropriate, Users may request review of a moderation action.

    WorkKE may:

    • review the original Content;
    • restore legitimate Content;
    • remove an incorrect policy strike;
    • reverse an applicable restriction; or
    • uphold the moderation decision.

    Users must not abuse the review process or repeatedly submit Content designed to test or circumvent moderation systems.

    17. Wallet and Payment Misuse

    WorkKE financial features must only be used for legitimate Platform purposes.

    Users must not:

    • use WorkKE as a general money-transfer service;
    • deposit funds primarily for immediate withdrawal;
    • create fake transactions to move money;
    • use stolen payment methods;
    • conceal the source or destination of funds;
    • manipulate Wallet balances;
    • intentionally split transactions to evade applicable controls;
    • abuse chargebacks;
    • abuse refunds;
    • circumvent applicable fees; or
    • use payment features for unlawful purposes.

    Detailed Wallet and payment requirements are contained in the WorkKE Wallet Policy and Payments Policy.

    18. Off-Platform Payments

    Users must not request or make off-platform payments where the purpose is to avoid applicable WorkKE fees or transaction protections.

    Examples may include requesting direct payment through:

    • M-PESA;
    • bank transfer;
    • card payment;
    • another marketplace;
    • cryptocurrency; or
    • another external payment method

    instead of using an applicable WorkKE payment process.

    Transactions moved outside WorkKE may lose applicable WorkKE protections.

    19. Reviews and Ratings

    Reviews must reflect genuine marketplace experiences.

    Users must not:

    • purchase reviews;
    • sell fake reviews;
    • create fake transactions to generate ratings;
    • review their own services using another account;
    • coordinate rating manipulation;
    • threaten another User over a review;
    • offer prohibited incentives for positive reviews; or
    • submit knowingly false reviews.

    WorkKE may remove fraudulent, abusive, irrelevant, or otherwise prohibited reviews.

    20. Spam and Platform Manipulation

    Users must not:

    • send bulk unsolicited messages;
    • repeatedly post substantially identical jobs or listings;
    • scrape WorkKE without authorization;
    • use bots to manipulate Platform activity;
    • artificially increase views, applications, orders, sales, or ratings;
    • manipulate search or ranking systems;
    • abuse referral programmes;
    • exploit promotions;
    • interfere with normal Platform functionality; or
    • create artificial traffic.

    Reasonable use of approved integrations, APIs, or automation tools may be permitted where expressly authorized by WorkKE.

    21. Security and Platform Integrity

    Users must not attempt to:

    • gain unauthorized access to WorkKE;
    • bypass authentication;
    • bypass Wallet security;
    • bypass Contact Guard;
    • exploit vulnerabilities;
    • interfere with Platform availability;
    • conduct denial-of-service attacks;
    • access another User's account;
    • extract protected data;
    • reverse engineer protected Platform functionality where prohibited by law; or
    • circumvent technical restrictions.

    Users who discover a potential security vulnerability should report it responsibly rather than exploit it.

    22. Privacy and Personal Information

    Users must respect the privacy of other Users.

    Users must not:

    • harvest personal information;
    • sell User information;
    • publish private information without authorization;
    • use customer information for unauthorized marketing;
    • collect information through deceptive methods;
    • distribute stolen databases;
    • expose identity documents; or
    • otherwise misuse personal information.

    Vendors may use customer information only for legitimate purposes associated with applicable transactions or another lawful purpose.

    Personal data processing by WorkKE is governed by the WorkKE Privacy Policy.

    23. Harassment, Hate and Discrimination

    Users must not use WorkKE to harass, threaten, abuse, intimidate, or unlawfully discriminate against another person.

    Content or conduct that promotes violence or hatred against persons based on legally protected characteristics may be removed and may result in account action.

    Legitimate professional discussion, criticism, or disagreement is permitted when conducted appropriately.

    24. Exploitation and Unsafe Activity

    WorkKE must not be used to facilitate:

    • human trafficking;
    • sexual exploitation;
    • child exploitation;
    • forced labour;
    • extortion;
    • credible threats of violence;
    • unlawful sale of weapons;
    • unlawful sale of controlled substances; or
    • other serious unlawful or exploitative activity.

    WorkKE may take immediate action in serious cases.

    25. Regulated and Restricted Services

    Certain professional or regulated services may require licences, qualifications, approvals, or other legal authorization.

    Users offering such services are responsible for ensuring they have all required authorization.

    WorkKE may request evidence of applicable qualifications or authorization.

    WorkKE may restrict categories that create unacceptable legal, financial, safety, or marketplace risk.

    26. Misuse of WorkKE Branding

    Users must not falsely claim to:

    • represent WorkKE;
    • be employed by WorkKE;
    • be an authorized WorkKE agent;
    • have an official WorkKE partnership;
    • have WorkKE endorsement; or
    • have certification or verification not actually granted by WorkKE.

    Users must not use WorkKE trademarks, logos, or branding in a misleading manner.

    27. Reporting Violations

    Users may report suspected violations of this Policy to WorkKE.

    Reports should contain enough information for WorkKE to reasonably investigate the issue.

    Users must not knowingly submit false reports against competitors, Clients, Vendors, or other Users.

    WorkKE may maintain appropriate confidentiality regarding investigations and enforcement actions.

    28. Enforcement

    WorkKE may consider the severity, frequency, intent, impact, and risk associated with a violation.

    Depending on the circumstances, WorkKE may:

    1. provide an educational notice;
    2. issue a warning;
    3. mask or remove Content;
    4. record a policy violation or strike;
    5. restrict particular Platform functionality;
    6. restrict messaging;
    7. remove a job, proposal, product, or Store listing;
    8. restrict Digital Store functionality;
    9. restrict Wallet or payment functionality;
    10. temporarily suspend an account;
    11. permanently terminate an account; or
    12. take other reasonable action permitted by WorkKE policies or applicable law.

    WorkKE does not have to apply these measures sequentially.

    Serious violations may result in immediate suspension or termination.

    29. Repeat Violations

    WorkKE may consider previous policy violations when determining appropriate enforcement.

    Repeated attempts to violate or circumvent this Policy may result in stronger restrictions.

    For applicable Contact Guard violations, WorkKE may use a graduated process such as:

    education → warning → strike → temporary restriction → further account action.

    The exact response may depend on the severity and circumstances.

    30. Serious Violations

    WorkKE may immediately restrict or suspend activity involving suspected:

    • serious fraud;
    • identity theft;
    • stolen payment information;
    • malware;
    • serious security attacks;
    • child exploitation;
    • human trafficking;
    • credible threats;
    • serious intellectual property abuse;
    • unlawful financial activity; or
    • other serious illegal conduct.

    Where appropriate or legally required, WorkKE may preserve relevant information and cooperate with competent authorities.

    31. Appeals

    Where WorkKE provides an appeal or review process, Users may request reconsideration of eligible enforcement decisions.

    An appeal should explain:

    • why the User believes the decision was incorrect;
    • any relevant context;
    • supporting evidence; and
    • any technical or factual error involved.

    WorkKE may uphold, modify, or reverse the original decision.

    Repeated or abusive appeals may be restricted.

    32. Relationship With Other WorkKE Policies

    This Acceptable Use Policy establishes general rules governing acceptable conduct across WorkKE.

    More specific policies may apply to particular activities.

    For example:

    Wallet Policy governs Wallet balances, limits, funding and withdrawals.

    Payments Policy governs payment processing, fees, refunds, payouts and chargebacks.

    Vendor Agreement governs Vendors, freelancers and Digital Store sellers.

    Dispute Resolution Policy governs transaction disputes.

    Privacy Policy governs WorkKE's processing of personal information.

    Terms of Service establish the overall legal relationship between WorkKE and its Users.

    Where multiple policies apply, they should be read together.

    33. Changes to This Policy

    WorkKE may update this Policy to reflect changes in:

    • Platform functionality;
    • marketplace risks;
    • Digital Store functionality;
    • security practices;
    • payment systems;
    • moderation technology;
    • applicable law; or
    • WorkKE operations.

    Material changes may be communicated through the Platform, email, or account notifications where appropriate.

    The Last Updated date will indicate the latest revision.
